COLD STONE CREAMERY® “GOLD MEDALLION INSTANT WIN CONTEST”
NO PURCHASE NECESSARY TO PLAY. GAME OPEN ONLY TO LEGAL RESIDENTS RESIDING IN ONE OF THE FIFTY UNITED STATES OR DISTRICT OF COLUMBIA THROUGHOUT THE PROMOTION. THE GAME BEGINS 11/05/2008 AND ENDS ON 01/06/2009 OR WHEN GAME PIECE SUPPLIES EXHAUST, WHICHEVER OCCURS FIRST. GAME PIECES ARE ONLY AVAILABLE AT PARTICIPATING LOCATIONS WITHIN THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA. VOID WHERE PROHIBITED BY LAW.
1. HOW TO PLAY: Each time you purchase a qualifying Ice Cream Cake (small round, large round, small rectangle, large rectangle) at a participating Cold Stone Creamery location, you will receive a “GOLD MEDALLION” game piece (referred to as "game piece" in these rules). No Purchase Necessary. To receive one (1) free game piece without purchase, send a self-addressed, stamped envelope, with sufficient postage, postmarked no later than 01/06/2009 to be received by 01/31/2009 to Cold Stone Creamery “GOLD MEDALLION” Game Piece Request, P.O. Box 3116, St.Cloud, MN 56397-3116. Limit one (1) free game piece per request per stamped outer envelope. Residents of the state of VT may omit return postage. Cold Stone Creamery ("Sponsor") assumes no liability for lost, late, stolen, illegible, misdirected, mutilated, incomplete or postage-due mail.
2. INSTANT WIN PRIZES AND DISCOUNTS: Remove game piece where indicated to reveal a winning prize message indicating that you have won one (1) of the following prizes (subject to verification in accordance with these Official Rules). Prize message on actual game piece may be abbreviated or may vary from any prize message stated in these Official Rules. PRIZES: Three (3) Gold Medallion Prizes will be awarded, consisting of $10,000 in cash (awarded as a check). Estimated retail value (“ERV”) of each Gold Medallion Prize: $10,000.00. Odds of winning Gold Medallion Prize: 1 in 145,833 *.
Five (5) Silver Medallion Prizeswill be awarded, consisting of $500 in cash (awarded as a check). Estimated Retail Value (“ERV”) of each Silver Medallion Prize: $500.00. Odds of winning a Silver Medallion Prize: 1 in 87,500*. One-Thousand (1000) Bronze Medallion Prizes will be available, each consisting of one (1) Free Large Round Signature Cake Creation. Estimated Retail Value (“ERV”) of each Bronze Medallion Prize: $28.43. Odds of winning a Bronze Medallion Prize: 1 in 437*. Total (“ERV”) of all available prizes is: $60,930. *Odds are based upon estimates of the number of game pieces produced; actual odds may vary depending upon the actual number of game pieces released into the marketplace.
3. TO CLAIM GOLD MEDALLION PRIZE and SILVER MEDALLION PRIZE BY MAIL: To submit a prize claim for the Gold Medallion Prize and Silver Medallion Prize, mail the original entire potentially winning game piece along with a 3 x 5 inch piece of paper clearly hand printed with your name, complete street address and daytime phone number to Cold Stone Creamery “GOLD MEDALLION” Prize Claim, P.O. Box 3116, St. Cloud, MN 56397-3116. Please retain a copy for your records. You are not a winner until your game piece has been timely received and verified in accordance with these Official Rules. Gold Medallion Prize and Silver Medallion Prize mail-in prize claim must be postmarked no later than 02/06/2009 and received by 02/20/2009 to be claimed. Allow ten (10) to twelve (12) weeks from the date prize claim is received by Sponsor for verification and delivery of prize. All potential Gold Medallion Prize and Silver Medallion Prize claims MUST be sent by Certified Mail, Return Receipt Requested. Proof of mailing does not constitute proof of delivery; proof of delivery does not constitute proof of a winning submission. Sponsor assumes no responsibility or liability for lost, late, delayed, postage due, misdirected or illegible mail or damaged, torn or separated mail due to improper packaging of mail or incomplete or improper processing of mail. Mail received without a verifiable and legible return address may not be accepted at Sponsor's sole discretion. The submission of a prize claim is solely the responsibility of the participant who assumes all risk of loss, damage, destruction, delay and misdirection of the prize claim.
4. TO CLAIM BRONZE MEDALLION PRIZES: Instant Win Bronze Medallion Prizes are redeemed instantly upon your next store visit to participating Cold Stone Creamery locations. All Free Ice Cream Cake game pieces must be redeemed by 01/31/2009 or prize will be forfeited. Unclaimed prizes will not be awarded.
5. ELIGIBILITY: You must be a legal resident of the United States 18 years of age residing in one of the fifty (50) United States or District of Columbia to be eligible to win. Void where prohibited. Employees of Kahala Corp, Cold Stone Creamery and all of their respective parents, subsidiaries, divisions, affiliates, distributors, suppliers, and advertising, promotional or judging agencies (collectively, "Sponsor and Promotion Parties") and the immediate family members of such employees and/or persons living within the same household as such employees are not eligible to win. If potential prize winner is a minor, prize may be awarded to the minor's parent or legal guardian who must assume all responsibilities of prize winner.
6. GENERAL CONDITIONS: Allow ten (10) to twelve (12) weeks from Sponsor's receipt of prize claim for verification and delivery of prize redeemed by mail. Gold Medallion Prizes and Silver Medallion Prizes unclaimed as of 02/20/2009 will not be awarded. Game pieces are available only at participating locations in the fifty (50) United States and the District of Columbia in compliance with these Official Rules. No substitution of prizes is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except as determined by Sponsor in its sole discretion. Void wherever prohibited or restricted by law. Prize winners will be solely responsible for paying all applicable federal, state and local taxes on prizes; if applicable, winner may receive an IRS Form 1099 for the retail value of the prize. All participants agree to be bound by these Official Rules and the decisions of Sponsor and it’s authorized judging agencies (the “Judges”) whose decisions in all aspects of this promotion shall be final and binding. You are not a winner until your potentially winning game piece has been timely received and verified by the Judges in accordance with these Official Rules, and you have fully complied with these Official Rules.
7. VERIFICATION: All submitted prize claims become the property of Sponsor and will not be returned. All potentially winning game pieces are subject to verification at the sole discretion of the Judges. Only specially marked “GOLD MEDALLION” game pieces distributed by Cold Stone Creamery during the duration of the game will be accepted and may not be combined with those from any other game. Anti-fraud detection devices may be used to verify winners. Game pieces will be void if they fail to pass anti-fraud detection measures, or if found to be photocopied, reproduced, altered, forged, defaced, tampered with, mutilated, torn, stolen, unissued, unauthorized, traded, bartered, sold, illegitimately obtained or illegible in any way, or if disassembled, or if they fail to contain authorized special markings and/or security codes, or if defective or if they contain printing or other mechanical errors or are printed or produced in error. No prizes will be awarded to the holder of a void game piece and Sponsor's sole liability in respect thereof will be to replace the void game piece with another randomly selected piece if Sponsor deems appropriate. In no event will Sponsor be obligated to award more prizes than the number of prizes stated in these Official Rules. If for any reason Sponsor determines in its sole discretion that the promotion is no longer capable of running as intended by these rules for any reason whatsoever Sponsor may at its sole discretion cancel, suspend or modify the promotion in whole or in part. For example, if due to printing, production, mechanical or other error more prizes for a particular prize category are either made available and/or claimed than the number of prizes set forth in these Official Rules, then Sponsor may suspend prize awards for such prize category and award any remaining unclaimed prizes (up to the total set forth in these rules) in a random drawing from among all eligible prize claimants for that prize category as determined by Sponsor.
8. PROMOTION END: Promotion is scheduled to end on the earlier of 01/06/2009 or when the supply of “GOLD MEDALLION” game pieces has been exhausted, whichever occurs first.
9. WINNER NOTIFICATION: Potential Gold Medallion Prize and Silver Medallion Prize winners may be required to sign and return an Affidavit of Eligibility/Liability Release with (where lawful) a publicity release within seven (7) days of the date on the notification letter. If any required documents are not returned within the required number of days, or if any mail is returned to Sponsor as undeliverable without a forwarding address, then prize may be forfeited. Any portion of a prize not accepted by winner shall be forfeited. Prizes will only be delivered to addresses within the United States.
10. RELEASE OF LIABILITY: All winners, by acceptance of a prize, agree to release Sponsor from any and all liability, or any typographical or other error in the Official Rules or the offering and announcement of prizes. Upon request, winner must consent (and confirm such consent in writing) to the use by sponsor and the promotion parties of his/her name, voice, picture or other likeness without compensation for promotional purposes in all media as determined by Sponsor and/or such promotion parties, except for residents of TN and where prohibited by law.
11. WINNERS LIST: For a list of Gold Medallion Prize and Silver Medallion Prize winners, send a self-addressed, stamped envelope, with sufficient postage, before 01/31/2009 to: Cold Stone Creamery “GOLD MEDALLION” Promotion Winners' List, P.O. Box 3116, St. Cloud, MN 56397-3116.
